Terms and Conditions for the Supply of Goods through the website you are connected to the User Agreement for XTRA-STAR Ltd (Trading as XSJ London), registered address is Octagon Point, 5 Cheapside, London. EC2V 6AA This service is operated by XTRA-STAR Ltd (XSJ London and XSJLONDON.com each separately and together in this Agreement, “we”, “us” or “our”). Company Registration number – 08874442
1. The Contract between you and us
We must receive payment in whole for the price of the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been received by sending an email to you at the email address you provide in your order form. This is not an Order Acceptance from XTRA-STAR. Our acceptance of your order takes place on the dispatch to you of the products ordered unless we notify you that we do not accept your order, or you have cancelled your order. Our acceptance of your order brings into existence a legally binding contract between us. Only adults (persons aged 18 and over) are entitled to enter into legally binding contracts and as a result are the only people entitled to transact through this site. Any other individuals who are unable to perform legally binding contracts are prohibited from ordering goods using this site. If you do not qualify do not use this site.
2. Pricing, Payment, Delivery and Discount Codes:
2.1 The prices payable for goods that you order are as set out in our website. When you submit your Order, you are offering to buy the Product(s) at the price set out in the Order. All prices are inclusive of VAT. Shipping costs (where applicable) and any import duty and taxes incurred will be added to the total amount due when you view the Product(s) in your Shopping Bag. The total cost for the Product(s) and delivery charges will be displayed before you confirm your Order and will be set out in the confirmatory email you receive from us.
2.1.1 All of our prices are in UK Pounds. You will be billed in UK Pounds and if you purchase from outside the UK, currency fluctuations and credit card charges may make a difference to the amount billed on your credit card.
2.2 Our prices may change at any time. If we discover that the price has changed or that there has been a pricing error when we receive your Order we will contact you and ask if you wish to proceed at the correct price. If you confirm that you do wish to proceed, please remember that we will still not be under an obligation to supply the Product(s) until we have sent you the second email confirming your Order.
2.3 All payments must be made at the time of our Confirmation. Payment for all Products must be by credit or debit card. We accept payment with Visa, MasterCard, Maestro cards and Paypal. If we are unable to accept or fulfill your Order for any reason then we will refund any money paid by you in respect of the Order. We will not dispatch the Product(s) until we receive payment in full.
2.3.1 For payment by card, all credit and debit cardholders and bank account holders respectively may be subject to authorisation and authentication. If the issuer of your payment card or our service provider refuses to, or does not for any reason authorise or validate the payment, we will not be liable in these circumstances for any delay or non-delivery in respect of the Product(s) which you have ordered as a result.
2.3.2 To ensure safe shopping, we are Verisign certified. We also use standard internet encryption technology to provide you with the maximum practicable level of security.
2.3.3 We do not hold any of your debit or credit card details anywhere on the Site. They are passed securely to our payments processor for authorisation by your bank.
2.4 You may be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website.
2.5 Promotional discount codes: We may from time to time offer promotional discount codes (either directly or via third parties) which may apply in respect of any, or certain specified, purchases made though this Website. Such codes may only be applied to purchases of full-price items and cannot be used in conjunction with any other offer or discounts.
2.6 Please note that prices in all printed publications are correct at the time of publication and we reserve the right to amend these without prior notification.
3 Engraving and Gift Messages
Please note that we are unable to process any engraving order or gift card messages using profanities or inappropriate language which may be submitted as part of your Order. Where possible, we will contact you to seek an alternative engraving or gift message and this will be done before we send you the second confirmatory email in respect of your Order.
4 Damage or Defective Product(s)
4.1 Subject to any specific warranties we offer in relation to any particular Product(s), or those which are implied by law, we do not offer any warranty or guarantee on our Product(s).
4.2 You should inspect the Product(s) when you receive them for defects or damage. If you find a defect or damage you must contact our Customer Care Team as soon as possible with you order reference number to hand.
4.3 If the Product(s) are found to be damaged prior to delivery to you, or defective (through no fault of your own wearing or use), we will repair or replace the Product(s) or refund the price paid by you, including any delivery charges you paid, provided that you have not worn or used and damaged the Product(s). We will either refund the cost of the return of the Product(s) to us by you or send you a prepaid parcel which you can use to return the Product(s).
4.4 If you would prefer repair or replacement of the Product(s) please contact us and we will replace the Product(s) at no extra charge to you where this is reasonably practicable.
5 Liability
5.1 Nothing in these Terms of Sale will limit our liability for:
5.1.1 fraud;
5.1.2 death or personal injury caused as a result of our negligence;
5.1.3 breach of any obligations implied by section 12 of the Sale of Goods Act 1979; or
5.1.4 any matter for which it would be unlawful for us to exclude or to attempt to exclude our liability.
5.2 Subject to clause 11.1 above, in no event shall we be liable to you for any business, financial, or economic loss nor any consequential or indirect losses, including but not limited to loss of business, loss or income or revenue, loss of profits or loss of anticipated savings.
5.3 Our aggregate, total liability to you for all damages, injury, losses and causes of action (whether in contract, tort or otherwise) arising from any Contract with you shall be limited to the price of any Product(s) you may order through our Site and is strictly limited to losses that were reasonably foreseeable. Losses are foreseeable where they could be contemplated by you and us at the time the Contract is formed.
6 Notices
6.1 All notices sent to you will be sent to the email address provided with your registration details (as updated by you). By accepting these Terms of Sale you give your consent to receive communications from us by email.
6.2 Personal information that you supply to us will not be disclosed by us to any third party save in accordance with our Privacy Policy. You agree that we may use the personal information supplied by you in accordance with our Data Policy.
7 Miscellaneous
7.1 We advise you to print a copy of your Order and these Terms of Sale for your information and safe keeping. You can download a pdf version of these Terms of Sale by clicking here.
7.2 No failure or delay by us in exercising any right or remedy provided by law or under these Terms of Sale and no single or partial exercise of any such right or remedy shall impair the right or remedy, or operate as a waiver or variation of it, or preclude its exercise at any subsequent time.
7.3 If any provision of these Terms of Sale is found to be invalid or unenforceable by a court, it will be deleted from the rest of these Website Terms which shall remain unaffected.
7.4 A person who is not a party to a Contract is not entitled to enforce any of its terms (including these Terms of Sale) under the Contracts (Rights of Third Parties) Act 1999.
7.5 No variations of these Terms of Sale are binding unless agreed by us in writing.
7.6 These Terms of Sale (and any document expressly referred to in them, including the Website Terms and Privacy Policy) represent the entire agreement between you and us in relation to the subject matter of any Contract.
7.7 These Terms of Sale are governed by and construed in accordance with the laws of England and Wales. You agree, as we do, to submit to the non-exclusive jurisdiction of the English courts.
8 Registration
8.1 In order to become a registered user of the Site and purchase our Products you will be required to provide some basic personal information.
8.2 You agree that all information supplied on registration is true and accurate and will be kept up to date at all times. We will use the information provided to us to contact you.
9 Delivery Information
All our orders are gift wrapped in beautiful packaging and sent via courier.
Free Standard UK Delivery - orders will arrive within 2-3 working days.
Next Day Delivery (£12) - orders made before 1pm will be delivered the next working day.
International Delivery (£15) - orders will arrive within 5-10 working days.
Out of stock items will be delivered within 6-8 weeks. For orders outside of the UK delivery time will be 8-10weeks.
You can track your order by logging into My Account. Tracking details are available from the moment your order is dispatched. This includes international orders.
10 Returns
We will guarantee you a full money-back refund within 28 days of invoice date on any item, as long as it is in the original condition.
Returns in the UK are now free.
Engraved items are non-returnable/non-refundable.
Goods purchased online must be returned to us in perfect condition and in their original packaging in order for us to process an exchange or refund. Good purchased online cannot currently be returned at XTRA-STAR boutiques and counters.
Processing your Refund
Upon receipt of items, the credit or debit card originally used for the purchase will be credited with the cost of the goods minus the delivery charges (exceptions may apply). We will process your refund within 48 hours of receipt. Your credit card company may take 4-7 working days to credit your account.
Right for you to cancel your contract
1 Subject to 3 below, you may cancel your contract with us for the goods you order at any time up to the end of the seventh working day from the date you receive the ordered goods. You do not need to give us any reason for cancelling your contract nor will you have to pay any penalty.
2.1 To cancel your contract you must notify us by email at [email protected] or in writing (to XSJ London, Octagon Point, 5 Cheapside, London. EC2V 6AA) giving us your name, address and order reference number, OR
2.2 by completing the model cancellation form available on the Site www.xtra-star.com and returning it to the address specified in that form.
3 Your right to cancel your contract with us for the goods you have ordered is subject to:
a) You email us within 7 days at [email protected] of receiving your goods and receiving a ‘Returns Authorisation number’.
b) The item(s) cannot be a Bespoke Special Order, which due to their unique nature, cannot be exchanged or returned under any circumstances.
4 Once you have notified us that you are cancelling your contract, any sum debited from your credit card will be credited to your account as soon as possible and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you, in the way detailed above, we shall be entitled to deduct the direct costs of recovering the goods from the amount to be credited to you.
